Welcome to nycjunkcarquotes.com (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website and services, including requesting junk car quotes (“Seller Services”) and purchasing lead credits as a buyer/provider (“Provider Services”). By using the site, you agree to these Terms.

1) Who we are

We are a marketplace that connects car sellers with local buyers/providers in Queens, NY and nearby areas. We are not a dealer and do not purchase vehicles ourselves.

2) Eligibility

• You must be at least 18 years old and able to form a binding contract.
• Provider accounts must be for legitimate businesses operating in the U.S.

3) Seller Services

• Submitting a quote request is free and does not obligate you to sell.
• We may share your request details with a matched local buyer (name, phone, email, ZIP, vehicle details, and any info you submit).
• Offers, pickup times, and payments are arranged directly between you and the buyer.

4) Provider Services (Pay-Per-Lead)

• Providers can purchase “lead credits.” 1 credit = 1 delivered lead (a real person’s request from your covered ZIPs).
• Credits never expire. We route new leads while you have credits available.
• Non-exclusive leads may be shared with multiple buyers/providers. We do not guarantee exclusivity.
• Failed sale ≠ refund: If a lead does not convert to a sale, that alone does not qualify for a refund. See the dispute policy below.

5) Pricing & Payment

• Payments are processed by Stripe. Taxes may apply.
• We may change prices prospectively at any time.
• Chargebacks may result in suspension of your account and loss of access.

6) Lead Quality, Disputes & Refunds

• If a delivered lead is clearly invalid (e.g., fake phone number, non-existent contact, wrong geography), you may submit a dispute within 7 days using the link in the lead email.
• If we verify the lead is invalid, we will restore 1 credit. Otherwise, the credit remains consumed.
• Important: Outcomes like “no answer,” “changed mind,” “offer not accepted,” or “seller sold elsewhere” are not considered invalid and are not refundable.

7) Provider Responsibilities

• Keep your coverage ZIPs accurate and your contact channels monitored.
• Comply with all applicable laws (telemarketing, texting, towing, disposal, etc.).
• Use leads solely to contact the seller regarding their request; no resale/spam.

8) Acceptable Use

• No unlawful, misleading, or abusive activity.
• No automated scraping or attempts to bypass rate limits or security.
• No harassment of sellers or other providers.

9) Intellectual Property

The site, brand, and content are owned by us and protected by law. You may not copy, modify, or distribute our materials without written permission.

10) Disclaimers

We provide the services “as is” and “as available.” We do not guarantee any specific number of leads, conversion rates, prices, pickup times, or outcomes. We are not liable for agreements between sellers and providers.

11) Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use. Our total liability for any claim is limited to the amount you paid to us in the 3 months before the claim arose.

12) Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the services, your communications with sellers, or your violation of these Terms or the law.

13) Termination

We may suspend or terminate access at any time for misuse, non-payment, fraud, or risk. You may stop using the services at any time. Unused credits remain on your account unless the account is terminated for cause (e.g., fraud).

14) Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York (without regard to conflicts of laws). You agree to the exclusive jurisdiction of state and federal courts located in New York County, New York.

15) Changes to Terms

We may update these Terms from time to time. We’ll post the new date at the top. Your continued use constitutes acceptance of the updated Terms.
